1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Valedictorian (the "Service"), operated by Valedictorian ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
These Terms should be read alongside our Privacy Policy, which describes how we handle your information.
2. Eligibility & Age Requirements
You must be at least 13 years old to create an account and use the Service's core features. Users under 18 should review these Terms with a parent or guardian.
Users under 13: We do not permit children under 13 to use account-gated features. If we learn that a user under 13 has accessed restricted features without verifiable parental consent, we will terminate that access and delete the associated data. See our Privacy Policy for details on children's privacy.
Parents and guardians: By allowing your teen to use Valedictorian, you accept these Terms on their behalf and are responsible for supervising their use.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with others
- Be solely responsible for all content you submit to the Service
4. The Service & AI-Generated Content
Valedictorian provides AI-powered study assistance, including essay feedback, writing practice, translation, and related educational tools. The feedback and content generated by the Service are produced by artificial intelligence and may contain errors, inaccuracies, or misleading information.
You are responsible for reviewing and verifying all AI-generated output before relying on it or submitting it for any academic or other purpose. Valedictorian is a study aid, not a substitute for your own judgment, research, or academic integrity policies.
Academic integrity: You are solely responsible for how you use the Service and for complying with your school's or institution's academic honesty and plagiarism policies. We do not endorse submitting AI-generated content as your own original work.
5. Subscriptions & Billing
We offer free and paid subscription plans, including "Plus" and "Exclusive" tiers. Paid plans are billed on a recurring (monthly or yearly) basis until canceled.
- Pricing: Current pricing is displayed on our Pricing page and may change at any time; changes apply to future billing cycles
- Automatic renewal: Paid subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date
- Cancellation: You may cancel your subscription at any time; cancellation stops future renewals but does not refund the current billing period
- Refunds: Refunds are handled at our discretion in line with applicable law; contact us at the email in Section 12 for refund requests
- Fee changes: We will provide reasonable notice before changing subscription fees
Payments are processed by our third-party payment processor. We do not store your full card details.
6. Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:
- Using the Service for any unlawful, fraudulent, or harmful purpose
- Submitting content that is unlawful, harassing, defamatory, or infringes others' rights
- Attempting to disrupt, overload, or compromise the Service or its infrastructure
- Reverse engineering, scraping, or extracting data from the Service without permission
- Circumventing subscription limits or access controls
- Using the Service to facilitate academic dishonesty on behalf of others
We may suspend or terminate access for any violation of these Terms.
7. Your Content
You retain ownership of the content (essays, text, writing) you submit to the Service. By submitting content, you grant us a limited, non-exclusive license to process it solely to provide the Service to you (e.g., generating feedback or translations), as described in our Privacy Policy.
You represent that you have the right to submit your content and that it does not violate any third-party rights.
8. Intellectual Property
The Service, including its design, features, branding, and software, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or proprietary content except as needed to use the Service as intended.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:
- The Service will be uninterrupted, error-free, or completely secure
- AI-generated feedback or content will be accurate, complete, or suitable for your needs
- Use of the Service will result in improved grades or academic outcomes
You use the Service at your own risk. Educational outcomes depend on many factors outside our control.
10. Limitation of Liability
To the fullest extent permitted by law, Valedictorian and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, grades, academic standing, or profits, arising from your use of or inability to use the Service.
Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or, for free-tier users, to the greater of $10 or the minimum allowed by applicable law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause or notice. Upon termination, your right to use the Service ends immediately.
Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will remain in effect.
12. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Last updated" date at the top of this page
- For significant changes, we will notify you by email or a prominent notice within the app
- You can always review the latest version at /terms-of-service
Your continued use of the Service after changes are posted means you accept the updated Terms.
